May 1968 was a period of great creativity in Paris. The students’ slogans of students covered the walls of the capital. The most famous remains:

“ Power to the imagination “.

At that time, the students thought that society is blocked because citizens are not allowed to give free rein to their imagination. For them, the power to the imagination will open the road leading to a better world.

In his speech of the May 24th, 1968, General de Gaulle sees in the student revolt “signs which demonstrate the need for a mutation in our society. Mutation which must include the effective participation of each one in the ongoing and in the result of the activity which concerns him directly”.

The vision is prescient. The General launches his famous Referendum on Participation the following year. French society is not ready. It refuses change. The no wins with 52% of the vote.

In response to the economic problems linked to the first oil crisis (1973), the idea resurfaces: “In France, we have no oil, but we have ideas”. Technical creations of prime importance emerge. In a cellar of Châtenay-Malabry, MM. Gernelle and Truong make the heart of the “Micral” beat: the first world microcomputer is born.

Six years later, the government supports the Minitel initiative; it is the ancestor of Internet networks. France is at the origin of many of the creations that have contributed to the emergence of the new world we have entered today with digital technology.

Half a century after May 1968, the thoughts of the students and General de Gaulle appear very topical. Power to the imagination is our only hope to quickly break with the disastrous course of time: rising unemployment, disastrous migrations, destruction of species, poisoning of the underground, pollution of the soil, the air, the seas and space, storms of all kinds, climate change and pandemics.

Our economic and social structures must be transformed as soon as possible to allow creators to respond to the imperatives of ecological transition. Ecological change, renewal of production methods and reduction of unemployment depends essentially on the creations, and on the investments that they can mobilize.

Thanks to smartphones, every human being can participate in the ongoing and in the result of activities that concerns him. All humans can also spread their creative ideas, gather the necessary skills and offer the economy and the ecology all the projects it needs.

However, the change faces strong resistance from the established order. The action of startups that multiply creative initiatives is largely paralyzed by an intellectual property system formed to serve a few, preserving as much as possible the situations acquired.

In order for individual initiatives to be liberated and to flourish as needed, all creators should be allowed to:

• use the property rights they hold over their works,

• attract the necessary financial investments because of strong profitability prospects,

• act according to the demands of their conscience to meet present needs.

Within the framework of international law, this transfer of responsibility is possible. It is even required by article 27 of the Universal Declaration of Human Rights.

“Everyone has the right to the protection of the moral and material interests resulting from any scientific, literary or artistic production of which he is the author”.

Building on the requirements of the United Nations, EU Directive 2019/790 contains the seeds of the creative revolution the world needs. It recognizes indeed to all authors the right to set the conditions under which their creations can be put online on the digital market.

A new standard is needed to give creators the effective means to change the world. So, they may become morally and legally responsible for the use of works under their control. Their conscience will override the financial imperatives, which today still determine the government of the world.

In the first part of this book, we will study the reform of property law which is underway.

In the second part, we will describe the tools that will enable creator to play their role effectively.
